A recitation of the facts will not be deemed necessary in view of our disposition of this cause other than to state that the homicide grew out of the fact that appellants wife had left him and the deceased had furnished the money in order for her to do so. Appellants wife did not testify. At the time of the trial of this cause there was pending a civil suit brought by the appellant against deceaseds mother, alleging that she and deceased had conspired to alienate appellants wifes affections. Appellant placed his reputation in issue. The state offered no evidence that his reputation was bad.
