The opinion of the court was delivered by On September 3, 1950, the movant, Charles E. Ray,
[202 Kan. 145]
a soldier stationed at Fort Riley, shot and killed a character by
the name of James G. Raftery, in Saline County. A charge of first
degree murder was lodged against Mr. Ray, a warrant was issued
for his arrest, and Ray was returned to Salina to face the music.
