The actions were based on personal injuries and property damage arising from an explosion which occurred May 15, 1954, at a creamery owned by Ray Wadzinski in Pittsville, Wood county, Wisconsin. Most of the personal injury actions were brought by plaintiffs as assignees of Hardware Mutual Casualty Company, workmens compensation insurer of Ray Wadzinski, and the property damage cases were also for the most part by assignees of fire insurance companies. The plaintiffs are of the following classes: The owners of the building, Ray Wadzinski and Genevieve Wadzinski; the owner of the adjoining building; the tenants in the creamery building; insurers of the various properties of the parties; and employees of the creamery who were injured and who sue for themselves and as assignees of Hardware Mutual Casualty Company. The cases were consolidated for trial under the name of Ray Wadzinski v. Cities Service Oil Company for convenience. From judgments dismissing the plaintiffs complaints, plaintiffs appeal.
