Defendant was convicted of delivery of a controlled substance. On appeal, he assigns error to the trial courts denial of his motion to suppress evidence. The motion was based on defendants argument that the evidence was discovered after police officers, in violation of Article I, section 9, of the Oregon Constitution and the Fourth Amendment to the United States Constitution, stopped and questioned him and a companion without reasonable suspicion that they had been involved in criminal activity. We reverse and remand.
