We have become partial to the word "glacial" in describing the pace of mortgage foreclosure actions, primarily in judicial foreclosure states. Unprecedented case volume, concomitant court congestion and delay imposed by oppressive new foreclosure statutes are but a few of the factors making it ever more difficult for a mortgage holder or servicer to obtain its remedy, even though there is no doubt that the borrower is in default. Although faced with what are sometimes monumental roadblocks, servicers are nonetheless obliged to be exquisitely meticulous in following every rule of practice and procedure while adhering unwaveringly to investor guidelines; none of this is an easy path.
