The plaintiff recovered a judgment for personal injuries resulting from a broken glass window of the defendant. The case was tried to the court and jury. In its special verdict the jury found the defendant was casually negligent in respect to the manner and method of construction and maintenance of the glass window, the plaintiffs left eye was injured by a particle of glass from the window and assessed damages in the amount of $155 for medical expenses, $240 for loss of wages and $15,000 for personal injuries. The trial court approved the verdict on the issues of negligence and causation but found the damage award excessive and granted a new trial with the option to the plaintiff to remit the excess over $216 for loss of wages and the excess over $5,000 for personal injuries. The plaintiff elected to accept the option. Judgment was accordingly entered and the defendant appeals.
