FACTS. - Haslam, an orthopedic surgeon, replaced Mikkelsen's hip. Mikkelsen and her witnesses testified that Haslam advised
Mikkelsen that she could ski and that her replacement hip created no physical limitations. Mikkelsen collapsed while skiing,
and suffered great pain and partial incapacity. PROCEEDINGS. - Mikkelsen sued Haslam for malpractice. Some of her jury instructions were refused, and the jury found that
she was contributorily negligent and/or assumed the risk. Mikkelsen appealed.
