Publisher Description
Defendant appeals the denial of his Rule 29.15 motion after an evidentiary hearing. We affirm in part, reverse in part and remand for resentencing. A jury convicted defendant of: (1) four counts of forcible rape; (2) two counts of felonious restraint; (3) one count of kidnapping; (4) two counts of armed criminal action; (5) one count of sodomy; (6) one count of second degree assault; and (7) one count of stealing over $150.00. The crimes at issue involved four victims. The trial court sentenced defendant, as a prior and persistent offender, to seventy-five years for each of the rape and armed criminal action counts, ten years for each kidnapping and sodomy count and seven years for each of the second degree assault, stealing and felonious restraint counts. The trial court ordered the sentences to run consecutively. Defendant filed a Rule 29.15 motion and a subsequent amended motion. After an evidentiary hearing, the court denied defendant's motion and a consolidated appeal followed.
