Edwin Conrad v. Fred M. Evans

The plaintiff was appointed receiver of Suburban Builders, Inc., under the provisions of Chapter 273, Stats., (Remedies Supplementary to Execution) at the instance of the Wisconsin Department of Taxation and is seeking to marshal the assets of that corporation so that its delinquent taxes can be paid. He brought the instant action against the defendant to recover monies of the corporation which the defendant is alleged to have received from the corporation without consideration or for a pretended but nonexistent consideration.
