Bill, seeking the termination of a testamentary residuary trust. By its terms the plaintiff is given the income of it for her life, subject to a partial bestowal thereof upon two others, who have both deceased after surviving the testator. Certain provisions are made for the disposal of the remainder interest after the Conclusion of the life estates. The plaintiff claims a failure of conditions attaching to them and a consequent intestacy of the remainder. She is the testators sole heir-at-law, and asserts that her ownership of the remainder interest operates to extinguish her equitable life estate.
