Argued: October 28, 1999 Appeal from judgments of the United States District Court for the Eastern District of New York (Reena Raggi, Judge) and the United States District Court for the Southern District of New York (Whitman Knapp, Judge) dismissing under Fed. R. Civ. P. 12(b)(6) the respective complaints of the Equal Employment Opportunity Commission on the sole ground that Title I of the Americans with Disabilities Act, 42 U.S.C. §§ 12111-12117, does not forbid employers from offering long-term disability benefit plans that provide less coverage for mental and emotional disabilities than for physical disabilities. Affirmed.
