Publisher Description

Before WINTER and RUSSELL, Circuit Judges, and MERHIGE,* District Judge. After study of the briefs and the record, and after hearing oral argument, we are persuaded that the district court correctly entered judgment for defendants. In this diversity case, plaintiffs' right to damages is, under Maryland law, to be determined by the law of Connecticut where the death of Mrs. Feldman took place, and under Connecticut law they have no right to recover. Even if the Maryland law of recovery for wrongful death were to be applied, they would have no compensable damages under the applicable rule.
