Jack Keefer and Another v. Al Johnson

Actions in the Hennepin County District Court by plaintiff Jack Keefer to recover for personal injuries allegedly caused by
the negligence of defendants, Al Johnson Construction Company and Peter Kiewit Sons' Company, at a construction site where
Keefer was working for Wiscombe Southern Painting Company in performance of its subcontract with said defendants; and by Pacific
Employers Insurance Company, Wiscombe's compensation insurer, to recover benefits paid Keefer. Defendants joined Wiscombe
as a third-party defendant to obtain indemnity. The cases were tried before Douglas K. Amdahl, Judge, and a jury, which found
in a special verdict that the negligence of the parties contributed to the injuries in the following proportions: Defendants,
28 percent; third-party defendant Wiscombe, 55 percent; plaintiff Keefer, 17 percent. Defendants and third-party defendant
each appealed from an order denying their alternative motions for judgment notwithstanding the verdict or for a new trial. AUTHOR: MURPHY
