This appeal concerns the propriety of a summary judgment issued by an administrative hearing officer in a workers compensation case. The summary judgment denying appellant Gordon Jacksons application for modification was, upon Jacksons petition for review, affirmed by the district court. Because we find such summary adjudication fails to comport with the procedures statutorily mandated for workers compensation cases and, therefore, exceeds the statutory authority of the office of independent hearing officers, we reverse the decision of the district court and remand to the administrative agency for a full hearing.
