Appellants, with twenty others, were indicted in the District Court of the United States for the Eastern District of South Carolina. The indictment contained three counts, the first count charging a conspiracy to violate the provisions of the National Prohibition Act and the provisions of the Tariff Act; the second, with smuggling intoxicating liquors into the United States in violation of the Tariff Act (Tariff Act 1930, § 593 [19 USCA § 1593]); and, the third, with transporting intoxicating liquors in violation of the National Prohibition Act (title 2, § 3 [27 USCA § 12]). A nolle prosequi was entered as to the second count of the indictment.
