Publisher Description

1 Appellants James Colt Jones and his parents, James and Betty Jones, appeal from the trial courts grant of summary judgment in this personal injury action in favor of Cochise County, Cochise County Sheriff Larry Dever, and Paul and Cheryl Matthews (collectively, "the County"). The trial court determined the notice of claim the Joneses had filed with the County pursuant to A.R.S. § 12-821.01 did not meet the statutory requirements. Because we conclude the notice of claim satisfied the statute, and because the County waived the statutory defenses in any event, we reverse and remand the case to the trial court.
