PROCEEDINGS. - Mascaro and Taylor took a default judgment against Davis and Joseph. Two motions by Joseph to set aside the default judgment were denied; then his motion to stay execution was granted. A settlement was reached at a pretrial conference, which Mascaro later refused to honor, but which the district court summarily enforced. Joseph then moved again to set aside the default judgment against him, which the court granted to the extent that the original claims against him had not been otherwise satisfied in settlement. Mascaro appealed.
