DECISION & ORDER In a juvenile delinquency proceeding pursuant to Family Court Act article 3, the appeal is from an order
of disposition of the Family Court, Kings County (Demarest, J.), dated April 19, 1990, which, upon a fact-finding order of
the same court, dated March 9, 1990, made after a hearing, finding that the appellant had committed acts which, if committed
by an adult, would have constituted the crimes of criminal possession of stolen property in the fourth degree, criminal possession
of stolen property in the fifth degree, grand larceny in the fourth degree, petit larceny, unauthorized use of a vehicle in
the third degree, and criminal mischief in the fourth degree, adjudged him to be a juvenile delinquent and placed him on probation
for a period of 12 months. The appeal brings up for review the fact-finding order dated March 9, 1990. Ordered that the order of disposition is modified, on the law, by adding thereto a provision vacating those provisions of
the fact-finding order finding that the appellant had committed acts which, if committed by an adult, would have constituted
the crimes of criminal possession of stolen property in the fourth degree, criminal possession of stolen property in the fifth
degree, grand larceny in the fourth degree, petit larceny, and criminal mischief in the fourth degree, and dismissing these
counts of the petition; as so modified, the order of disposition is affirmed, without costs or disbursements, and the fact-finding
order is modified accordingly.
