Michael Christopher Epps appeals his conviction of attempted burglary of a habitation. Following a jury verdict of guilty, the trial court assessed punishment, enhanced by two prior convictions, at forty-five years confinement. In eight points of error, Epps generally complains that the trial court erred in: (a) failing to grant his motion to quash the indictment; (b) admitting the photographic line-up into evidence; (c) failing to grant his motion for an instructed verdict; and (d) failing to instruct the jury on the lesser included offense of attempted criminal mischief. We disagree. Accordingly, the trial courts judgment is affirmed.
