Pagotto v. State

Although as yet no Maryland decision has had to come to grips with the issue, it is logically ineluctable that even a prima
facie case of gross criminal negligence would not, ipso facto, survive a motion for judgment of acquittal on a murder count
and justify submitting to the jury a charge of second-degree murder of the depraved-heart variety.
