Publisher Description

Paul and Judy Blume were jointly convicted of two counts of first-degree assault and one count of fourth-degree assault. The
Blumes appeal, contending that the trial court erred in ruling that their five-year-old daughter, A.B., was competent to testify
as a prosecution witness. The Blumes also argue that the court violated their constitutional right to confrontation by requiring
them to remain outside the physical presence of their daughter while she testified at trial. 1 Although we affirm the trial
court's finding that A.B. was competent to testify, we conclude that the court erred in denying the Blumes the right to face-to-face
confrontation with A.B. at trial. FACTS
