Publisher Description

Mortgage -- redemption -- application for relief under mortgage moratorium law. 1. A petition for relief under the mortgage moratorium law, L. 1933, c. 339, was served and filed before the expiration of the period of redemption from the mortgage foreclosure. Accompanying it was a notice that the matter would be brought on for hearing, and an order granting the relief wanted would be applied for, at a time shortly after the end of the redemption period. The petition, not the notice, was the application required by the statute to be made before the expiration of the period of redemption, and it is sufficient that it was served and filed within that time.
