Action commenced January 20, 1944, by Gertrude Kohl Saxhaug to recover damages for the alleged unlawful death of her husband, Harry Kohl, resulting from the collapse of a building owned by the defendant, Forsyth Leather Company, and leased to the employer of the deceased. Liberty Mutual Insurance Company, the compensation insurance carrier for the employer, was interpleaded as plaintiff. Judgment was entered October 30, 1947, in favor of the plaintiffs for $12,500 damages and costs, in all the sum of $13,011.27. Defendant appeals.
