Publisher Description

This appeal raises the familiar problem of determining under what circumstances a trademark owner may protect his trademark against use on products other than those to which the owner has applied it. Polaroid Corp. v. Polarad Electronics Corp., 287 F.2d 492 (2d Cir.), cert. denied, 368 U.S. 820, 7 L. Ed. 2d 25, 82 S. Ct. 36 (1961); King Research, Inc. v. Shulton, Inc., 454 F.2d 66 (2 Cir. 1972). Specifically, we must decide whether plaintiff, who uses the trademark "VERA" on a well-known line of womens scarves, apparel, and lines, is entitled to prevent defendants use of the same mark on cosmetics and fragrances.
