Notwithstanding the state's failure to provide defendant with notice pursuant to Minn. R. Crim. P. 9.04, subd. 1(4) prior to inspecting defendant's car, the trial court did not abuse its discretion in admitting evidence relating to the condition of defendant's car, and the interests of justice do not require that defendant be given a new trial. Heard, considered and decided by the court en banc.
