Publisher Description

Defendant was convicted by the Nicollet County District Court, sitting without a jury, of introducing contraband into the Minnesota Security Hospital in violation of Minn. St. 243.55. The issues on appeal are: (1) whether defendants waiver of a jury trial was invalid; (2) whether Minn. St. 243.55 applies to the Minnesota Security Hospital; (3) whether the search of defendants cell violated the Fourth Amendment; (4) whether the trial court erred by permitting two witnesses, whose names had not been previously disclosed, to testify; (5) whether the evidence is insufficient; and (6) whether the trial court made erroneous evidentiary rulings. We affirm.
