1 On January 18, 2002, Charles David Ellison ("Ellison") was convicted after a jury trial in Mohave County Superior Court of two counts of first degree murder and one count of first degree burglary. In February 2004, after sentencing proceedings before a separate jury, the superior court sentenced him to death for each murder. The trial judge also sentenced him to a concurrent sentence of twelve-and-one-half years for the burglary conviction. This is a mandatory appeal under Arizona Rule of Criminal Procedure 31.2(b). This court has jurisdiction under Article 6, Section 5(3), of the Arizona Constitution and Arizona Revised Statutes ("A.R.S.") section 13-4031 (1999).
