In an action to recover damages for personal injuries and property damage, the defendants and third-party plaintiffs appeal from an order of the Supreme Court, Westchester County (Ruskin, J.), entered January 23, 1984, which denied their motion for leave to enter a default judgment against the third-party defendant City of Yonkers on the condition that the third-party defendant pay the principal sum of $350 to counsel for the third-party plaintiffs and serve an answer within a specified time frame. Order affirmed, without costs or disbursements.
