Publisher Description

David M. Tench appeals his conviction for driving while intoxicated in violation of Code 18.2-266. Tench claims that because his drivers license had been suspended pursuant to Code 46.2-391.2 prior to his conviction and punishment for driving while intoxicated, he was twice placed in jeopardy for the same offense in violation of the United States Constitution. We disagree, and affirm his conviction.
