[U] Magana v. Silva

This case involves a sub-plat in rural Yakima County that has two lots on its southern edge. Lot 1 is owned by Jose Silva. Lot 2 is owned by David Silva and others. Tovias and Teresa Magana own adjacent property generally east of the sub-plat and have a 15-foot access easement across the southern part of the sub-platted property. The plat map, however, indicates a 30-foot private access easement across the Southern part of Lots 1 and 2. The Maganas sued to use the 30-foot easement and were successful in gaining summary judgment. Because material facts remain, we reverse.
