CONTIE, Circuit Judge. United Parcel Service ("UPS") seeks review and the National Labor Relations Board ("Board") seeks enforcement of the Boards Decision and Order finding that UPS violated the National Labor Relations Act ("Act") by issuing a warning notice to a UPS driver who refused to remove a union insignia lapel pin from his uniform. We grant UPS petition for review, deny the Boards cross-application for enforcement, and reverse the Boards Decision and Order.
