This is a consolidated appeal of two actions brought in the District Court of South Carolina by James Thomas Yarborough, Jr. and James Thomas Yarborough, Sr., respectively, against New Hampshire Insurance Company ("New Hampshire") and its agents. The first action arises out of New Hampshires attempt to collect a judgment against Pee Dee Realty & Insurance Agency, Inc. ("Pee Dee"). Yarborough, Jr. was the president and a shareholder of Pee Dee, and he brought a claim for relief against New Hampshire, its lawyer, RoyAnn Russ Murray, and Jack Flanagan, a collections agent for New Hampshire, alleging intentional infliction of emotional distress and violation of the Racketeering Influenced and Corrupt Organizations Act ("RICO"), 18 U.S.C. § 1961 et seq.
