Davis v. Ingerson

This action comes before us on a motion for a new trial by the defendant after verdict for the plaintiff at the June 1952 Term of Cumberland County Superior Court. The declaration contained three counts, one for abuse of process, one for malicious prosecution, and one for false arrest. The count charging false arrest by agreement of counsel was not pressed at the time of trial in the Superior Court. The following is a summary of the pertinent, admissible and material evidence:
