Action for wrongful death by plaintiff Joseph C. Pattermann against defendants city of Whitewater and TEP, Inc., to recover damages for the death of plaintiff's son who was drowned June 6, 1963, at a municipally owned swimming facility. TEP, Inc., was joined as a defendant because it had been conducting dredging operations where the drowning occurred under a contract with the city at the time. After issue was joined between plaintiff and defendant city, the latter moved for summary judgment. Attached to an affidavit of the deputy city clerk filed in support of the motion was a copy of the following notice which plaintiff served on, and filed with, the city clerk on October 3, 1963:
