This is an appeal by Dan Thomas ("Thomas"), from an order dismissing with prejudice his pro se, in forma pauperis suit under Chapter 14 of the Texas Civil Practice and Remedies Code. The Polk County trial court dismissed Thomass lawsuit with prejudice as frivolous, and assessed costs against Thomas. We modify the trial courts ruling and as modified, AFFIRM.
