Hardscrabble Ski Area v. First National

The plaintiffs in their complaint claim they were damaged by the failure of the defendant to timely furnish the proceeds of a loan negotiated with the defendant-bank. The complaint alleges three causes of action: (1) Breach of contract, (2) negligence in failing to process the loan within a reasonable length of time, and (3) misrepresentation. The cause of action for misrepresentation is not at issue in this appeal.
