George J. Barr v. Resolution Trust Corp‪.‬

The issue in this case is whether a claim by Sunbelt Federal Savings against George Barr based on a partnership promissory note and guarantee agreement is barred by the doctrine of res judicata. The trial court granted Barrs motion for summary judgment based on res judicata. The court of appeals, with one Justice dissenting, reversed the trial courts judgment, holding that the doctrine did not apply. 824 S.W.2d 600. We reverse the judgment of the court of appeals and affirm the trial courts judgment.
