Henry R. Horsey, Justice ORDER This 19th day of September, 1986, it appears to the Court that: (1) Home purchasers (not parties to this appeal) brought suit in Superior Court against John A. Shanks and Jane G. Shanks, his wife, appellants (Shanks), Terminex International, Inc., a Tennessee corporation, appellee (Terminex) and a realty firm, Crompton-Townsend, Inc. (not a party to the appeal), for damages arising from termites found in the home which plaintiffs purchased from defendants Shanks. The claims asserted against the various parties vary from fraudulent concealment to negligent inspection and false reporting. Defendants Shanks appeal Superior Court's denial of their motions to dismiss and for summary judgment in their favor on Terminex's cross claims against the Shanks and the realty firm for contribution and indemnification. The Court ruled that Terminex's settlement with and release obtained from plaintiffs was not a bar to Terminex's cross claim against the Shanks and that their tort liability remained to be determined.
