Argued: September 8, 1999 Appeal from judgment of the United States District Court for the Southern District of New York, Robert W. Sweet, J., denying defendants' motion to dismiss non-pecuniary damages. Held, the Death on the High Seas Act, 46 U.S.C. app. §§ 761-767 (DOHSA does not apply to a crash occurring about eight miles from the coast of the United States, in United States territorial waters.
