Publisher Description

ORIGINAL PROCEEDING FROM TRAVIS COUNTY Relator Texas Property and Casualty Insurance Guaranty Association (""Guaranty Association"") sought indemnification from the State of Texas pursuant to former Chapter 110 of the Texas Civil Practice and Remedies Code for the payment of part of a medical malpractice judgment against a qualifying physician. The State objected to indemnity, and the trial court sustained the State's objection. In this original proceeding seeking a writ of mandamus, the Guaranty Association challenges the denial of indemnification. We will conditionally grant the writ.
