Appellant was convicted by a jury of aggravated sexual assault of a child and assessed punishment at fifty years confinement in the Texas Department of Criminal Justice-Institutional Division. On January 20, 1994, this court affirmed appellants conviction. Rankin v. State, 872 S.W.2d 279 (Tex. App.-Houston [14th Dist.] 1994). Appellant filed a petition for discretionary review, which was granted by the Court of Criminal Appeals. On April 10, 1996, the Court of Criminal Appeals issued an opinion reversing and remanding the case to this court for further analysis. Rankin v. State, 974 S.W.2d 707 (Tex. Crim. App. 1996). After the State filed a motion for rehearing, the court issued a new opinion again reversing and remanding the case for further analysis.
