1. A physician who treats a patient for a physical condition cannot be liable in medical malpractice for a sexual relationship
with the patient where the physician does not engage in the sexual relationship under the guise of rendering treatment to
the patient. 2. A physician who treats a patient for a physical condition cannot be liable under Minn. Stat. § 148A.02 (1988) for a sexual
relationship with the patient where there is no evidence the physician performed or purported to perform psychotherapy on
the patient.
