WALSH, Justice: This is an appeal from a Court of Chancery approval of a class action settlement. The court approved the settlement as being
fair, reasonable and adequate and in the best interests of the class, over the objection of appellants. However, the court
did not determine that the named plaintiff was an adequate representative of the class. Because adequacy of a class representative
is a requirement of Court of Chancery Rule 23 and is constitutionally mandated, a determination to that effect is essential
to court approval of a class action settlement. Accordingly, without reaching the merits of the settlement, we reverse and
remand for an appropriate determination.
