Publisher Description

We are asked to decide whether the trial court correctly concluded that it may exercise general jurisdiction over Equitable Production, because it had "continuous and systematic" contacts with Texas, when Equitables national headquarters and principal place of business were relocated from Texas to another state three months before suit was filed. We hold that the relocation, although a significant factor, is nonetheless merely one factor to consider in resolving the jurisdictional issue; and Equitables contacts with Texas through the date suit was filed, although certainly diminished by the relocation, were nonetheless sufficiently continuous and systematic to support an exercise of general jurisdiction. We therefore affirm the trial courts order overruling Equitables special appearance.
